HUK  512 Criminal Procedure Law

The measures of protection in criminal procedure law are custody, arrest, apprehension, subpoena, search, seizure and other measures of protection like, ban to travel outside of the country, obey and accept the measures of medical treatment etc. are the topics to be studied and discussed in this course.

HUK 513 Criminal Law

The concept of illegality in general, the legal base of excusatory and mitigating causes, existing and non-existing in the Criminal Code are to be studied in this course. Excusatory causes non-existing in the criminal code are enforcement of a right, consent of victim, excusatory causes created by custom and analogy. Excusatory causes existing in the criminal code are mandatory provision and order of the supervisor, self-defense, state of necessity, mistake. These are the topic to be addressed and analyzed in this course.

HUK 526 Political Parties Law

In this course, actual matters concerning political parties, such as their establishment, their organizations, party leadership, party membership, intra-party democracy, party discipline, prohibitions imposed on political parties, dissolution of political parties and its results, financial audit of political parties, state aids to political parties, donation and membership dues will be studied and discussed.

HUK 531 Administrative Law

Non-discretionary power- discretionary power, the concept of appropriateness, the relationship of non-discretionary power with the element of subject, judicial doctrines and convictions concerning discretionary power, relationship between the concept of appropriateness and discretionary power, examples of the concept of appropriateness and discretionary power in the context of the Constitution and other legislative regulations, Conseil d’État and appropriateness are some of the topics that are examined and discussed in this course.

HUK 532 Administrative Procedure Law

Time limit for administrative lawsuit and problems concerning it will be discussed in this course from a normative perspective. In this sense, whether time limit is necessary? If necessary what should it be? The comparison of time limits applied in the civil adjudication and in the administrative adjudication, and also the comparison of the time limits applied in civil administrative adjudication and military administrative adjudication will be dealt with in this course.

HUK 539 EU Public Finance

Public debts, budget deficits and policies directed to disciplinary measures in public expenditures are among the topics to be studies within the scope of this course. Additionally, tax burden, problem of distribution of tax burden between direct and indirect (excise) taxes, electronic commerce and its taxation, environmental problem and taxation problem, taxation powers of local authorities, harmonization problem of Turkey with that of EU fiscal policies, EU budget, financial plans and expenditures for common policies are to be examined in this course.

HUK 540 Tax Systems of the European Union

Common taxation policies in the EU, international movements of capital and taxation, tax completion, state aids and tax incentives, double taxation and conventions for prevention of double taxation, fight against tax fraud, the problem of tax haven countries, legal basis of tax harmonization and its justification, harmonization of excise taxes, value added tax, private consumption tax are the subject-matters to be examined in this course.

HUK 544 Constitutional Adjudication

In this course, the concept of constitutional adjudication (judicial review) together with its legitimacy, its history, different models of judicial review, the status of Turkish Constitutional Court, its establishment and functions, the subject of judicial review, constitutionality blocks, the scope of judicial review and different ways of judicial review, the character of decisions of the  Constitutional Court, the procedure of judicial review and finally individual (constitutional) complaint mechanism will be introduced to students.

HUK 545 Economic Crimes and Punishments in Turkish Criminal Law

Today, white-collar crimes are increasingly growing. For this reason, scholars pay more attention to economic crimes and punishments in practice as well as in theory. In this course, following the explanation of criminal responsibility of corporate entities, the position of the Turkish Criminal Code concerning fight against economic criminality, and forfeiture, the relationship between the Turkish Criminal Code and codes containing special criminal provisions and special criminal codes will unveiled. After this, some crimes, such as bid rigging, banking embezzlement and manipulation will be particularly dwelled at too great length on details.

HUK 561 Public International Law

In this course, maritime law in general and the Turkey’s problems of maritime law in particular will be examined. In this sense, some concepts and issues will be particularly explained and discussed, such as continental shelf, territorial seas, the Islands of Aegean Sea, exclusive economic zone, the Turkish Straits.

HUK 564 Recent Developments in Theory of Public Service

There have important changes concerning public services and Turkish administrative organizations introduced and adopted to harmonize Turkish legislations with acquis communautaire. The goal of this course is to examine the public sectors being diminished through liberalization policies, and the role of state in this change.

HUK 572 Constitutional Law

This course offers students and opportunity to grasp knowledge concerning a particular aspect of constitutional law, i.e. the status of Turkish Constitutional Court, its establishment and functions, the subject of judicial review. More particularly, the decision of Turkish Constitutional Court concerning political party dissolution and the position of this decision vis-à-vis the European Court of Human Rights.

HUK 574 Law and Politics

This course offers student to gain a perspective concerning relationships between law and politics, the role of politics in law-making vice-versa.

HUK 576 Comparative Turkish-German Criminal Law

Fundamental concepts of criminal law, such as malice, negligence, attempt to commit a crime, participation in commission of a crime, joiner of offenses will be studied from a comparative law perspective by focusing on the Turkish and German criminal law, and different theories and practices concerning those concepts will be analyzed.

HUK 578 Medical Criminal Law

In this course, it is offered to student to look in detail into criminal liability of physicians due to negligence, patient rights, surgical intervention, and consent in medical treatments.
