HUK 514 New Contract Types

New contract types are aroused in consequence of the contracts which are concluded based on the freedom of contract principal, in order to meet the requirements of the parties as a result of the developments in daily and commercial life. Most of these contracts are innominate contracts that are not enacted. However, it is also possible to meet the enacted contracts that are enacted by a specific Act (Leasing Code) such as leasing contracts. Course content is composed by leasing, factoring, franchising, exclusive distributorship, exclusive purchasing contracts.

HUK 515 Security Contracts

Security contracts are the contracts which are concluded in order to guarantee the payment of an existing debt. The aim to secure the payment of the main debt that occurs from another relation underlies these contracts. Security contracts comprise the innominate contracts that are not enacted, besides the nominate contracts that are enacted. Course content is composed by the main security contracts as surety, pledge, commercial enterprise pledge, warranty, letter of guarantee.

HUK 519 Current Developments on Execution and Bankruptcy Law

Execution and bankruptcy law is a discipline which provides the owner of the right to obtain its rights. Nowadays, the shortage of cash prevents the enterprise operations. Therefore the creditor requires obtaining its credit erewhile. However, as a need of social state understanding debtor shall maintain its life after the distrainment proceeding. In this regard non-distrainable goods and rights, distrainment and conservation measures, redemption of distress, partition of money, postponement of bankruptcy, protection of creditors and concordatum are required to be reregulated. On the other hand, the main amendments on Turkish Commercial Code, Turkish Code of Obligations and Code of Civil Procedure concerns execution and bankruptcy law practice closely. Supreme Court practice alters continuously. These new codes and the amendments made to Code of Execution and Bankruptcy by the law no 6352 required to be examined. This course is recommended in order to examine these requirements.

HUK 520 Cases in Heritage Law

It is aimed to examine case types in heritage law, cancelation of testamentary disposition, abatement of legacies, testator simulation, action of recovery, disclaimer of inheritance and adjustment in heritage law in detail and to review current issues on these subjects.

HUK 522 Divorce and Legal Consequences of Divorce

Detailed information about legal consequences of divorce on conjoint and children, procedural issues about divorce cases and grounds for divorce matters as unsolved problems on legal consequences of divorce on conjoint and children exist. In scope of this course grounds for divorce, procedural issues about divorce cases and legal consequences of divorce on conjoint and children will be examined and current issues on these subjects will be reviewed.

HUK 523 Real Security

Real security which is meant to assurance subjected to property is to make the creditor to have a limited real right against a property of debtor or another third party in order to guarantee the credit. Real securities matter especially for banks in practice. In scope of this course moveable and immovable pledge, mortgage, mortgage bond and annuity bond will be examined.

HUK 524 Contract of Construction

Contract of construction which contractor undertakes to construct and conductor undertakes to make a payment is one of the most common contracts in daily life. In scope of this course, the definition of contract of construction, provisions, liability from defection, obligations of contractor, rights and obligations of conductor, payment, termination will be examined.

HUK 525 Triple Obligation Law

Obligations are relevant with the parties of this relation. Rights and obligations that arise from this relation may not affect third party. This result which is reached by the relativity of obligation is not absolute. Exemptions arising from codes or contracts that provide this relation to affect third party may be possible. The aim of this course is to examine these exemptions such as promise performance of third party, third party beneficiary contract, attendance in debt and attendance in contract.

HUK 533 Participation of Heritance

Participation concept, legal nature of participation, main principles of participation, participation rules that are arranged by legator, inheritor or law, participation made by the agreement of inheritors or court, liability of inheritors against each other or third parties after the participation will be examined.

HUK 535 Capital Market Law

In scope of this course, main concepts of capital market, institutions, actions, capital market instruments, capital market crimes and open joint stock company be examined in frame of applicable legislation.

HUK 537 Unfair Competition an Advertisement Law

In scope of this course, unfair competition concept which is regulated on the 54th and the rest articles of Turkish Commercial Code, examples, cases that may be filed against these actions, the ones that may be claimant and defendant, illegal advertisement methods and audition of these methods will be examined.

HUK 538 Legal Remedies

Legal remedies are served to review and alter the court decisions that are alleged to be wrong. These remedies will be examined in scope of this course. Objection, complaint, appeal, post-judgment relief, amendment of a decision, retrial, individual application to Constitutional Court, individual application to European Court of Human Rights will be considered separately and examined thoroughly.

HUK 541 (Marital) Property Law

(Marital) property which is regulated in Turkish Civil Code matters, especially the examination of the regime of participation in acquired property, in order to solve the problems in practice. Course content is composed by (Marital) property types, (Marital) property contract, regime of participation in acquired property, acquired property-personal property, residual value, regime of separation of estates and regime of community of goods.

HUK 542 Tort Liability

Tort liability is one of the most important subjects in Law of Obligations and regulated in detail in Turkish Code of Obligation law no 6098. In scope of this course tort liability concept and elements, scope of damage and compensation, form of payment, new regulation on pecuniary and non-pecuniary compensation arise from death and physical damages, especially compensation for loss of support, strict liability situations, risk liability, employer liability, liability of animal keeper, land owner’s liability, lapse of time will be examined.

HUK 543 Rental Contracts

The aim of the course is to examine the provisions of Turkish Code of Obligations law no 6098 on rental contracts which are one of the contracts that matter and common in daily life. Course content is composed by rental contract, form and validity of rental contract, rights and obligations of renter, termination of rental contact.

HUK 562 Cancellation of Labor Contract and Legal Consequences

Termination of labor contract by cancellation procedure, legal consequences of undue cancellation, fair/unfair- valid/invalid cancellation concepts and compensation in lieu of notice, severance, mala fide, labor security, invalidity of cancellation, reemployment case and its legal consequences, mutual rights and obligations in termination of contract will be examined.

HUK 571 Consumer Law

In scope of the protection of consumer law, consumer concept, the need of the consumer to be protected, the requirement of regulating this concept with a specific code, the measures aimed to protect consumer according to the Act on Protection of Consumer law no 4077, and consumer rights topics will be examined.

HUK 586 Competition Law

Competition is the underlying concept of operability and protection of market economies. Operability of markets depends on a healthy competition process. Therefore, legal regulations that protect competition concept as an institution rather than protecting people or enterprises are required. Course content is composed by the examination of The Act on The Protection of Competition law no 4054 that regulates Turkish Competition Law and the communiqués that are regulated by Competition Authority.
